Terms & Conditions

FLEUR markets products on its website only to retail customers and end consumers. Any order that does not correspond to a retail sale and in general any fraudulent or considered fraudulent order will be considered invalid by FLEUR and will not be processed.

 

The buyer declares before ordering that the purchase of the products from the FLEUR website is not connected in any way with his professional capacity and is exclusively for his personal use.

 

For the purposes of these General Terms and Conditions of Sale, the Buyer and FLEUR will be referred to collectively or individually as Parts or Parties.

 
Article 1 - Subject matter

These General Terms and Conditions of Sale are designed primarily to inform any potential buyer of the terms and conditions under which the seller (hereinafter " FLEUR " or "seller") will proceed with the sale and delivery of the products. to be ordered and, to define the rights and obligations of the parties in relation to the sale of the products from the seller to the consumer (hereinafter "the buyer"). They are valid without restrictions for all sales of FLEUR products presented on the website www.fleur.gr (hereinafter "the Website" or "the Page").

 

Therefore, the action of placing an order from the buyer for a product offered for sale on the FLEUR website is fully subject to the General Terms and Conditions of Sale, which the Buyer acknowledges that he was informed and accepted before placing his order.

 

FLEUR reserves the right to modify the General Terms and Conditions of Sale at any time. Applicable to each order are those that have been accepted by the buyer before placing his order.

 

The applicable General Terms and Conditions of Sale (hereinafter "GOPP") supplement the applicable General Terms of Use of the Website ofwww.fleur.gr , available at any time in the respective section.

Article 3 - Contracts and Orders

 

3.1 Invoicing-Shipping Costs

The selling prices of products in Euros, mentioned on the FLEUR Website, are valid at the time of placing the order by the buyer, including VAT and any other taxes. The selling prices of the products can be modified at any time by FLEUR, with a relevant announcement on the website before the pricing of the product. The buyer will be informed with a personal message about any changes before ordering. These prices are valid in the case of distance buying.

 

These prices do not include shipping costs, which are additionally invoiced at the price of the purchased products. Shipping costs are proportional to the volume of the buyer's order, so for orders over 30 euros no shipping costs are charged. For the remaining orders, the shipping cost is € 3.

 

The estimated delivery time is 2-3 working days within Attica from the day the order will be placed. However, due to increased volume and security measures, your order may be delayed.

The shipping settings are described in the following GOPP and can be modified at any time by FLEUR, but always before the time of ordering and invoicing of the customer and if he is informed. The prices include the valid value added tax (VAT) on the day of the order. Any change in the current percentage will be reflected in the price of the products sold by FLEUR, on its website. Ordering products automatically implies an obligation to pay the amount of the order on behalf of the Consumer. The products are priced at the amount of their value at the time of submission of the order by the consumer.

 
3.2 Product features

The buyer can choose one or more products of different categories available on the FLEUR Website.

 

FLEUR  may modify the variety of products presented on its Website, in accordance with specific restrictions related to its suppliers, subject to orders already placed by the buyer.

 

The products are compatible with the current Greek legislation on Cosmetics and the European Cosmetics Regulation.

 

FLEUR  can not guarantee that all the information on the product packaging has been translated into all the official languages of the European Union. However, this information is definitely available in Greek and / or English.

 

For any problem regarding the product as well as for any information that may be needed, the buyer can contact FLEUR at the Customer Service E-shop at 210-68.22.223, 24 hours a day, 7 days a week. The buyer can also visit a FLEUR store for personal advice and to try the products offered for sale by FLEUR .

3.3 Availability

In the context of the sale, the offer of the products to FLEUR is valid as long as the products appear on the website, within the limits of availability / exhaustion of the stock.

 

The availability of the products is notified to the buyer at the time of placing the order with a personal message, which the buyer is asked to confirm. If the information comes directly from our suppliers, changes or errors may occur from time to time.

 

In any case and in the possibility of total or partial unavailability of products after an order, the customer will be informed by telephone on the contact phone he stated during registration or via personal message in his contact e-mail, for the products that are without stock and regarding the partial or total cancellation of his order and the cancellation of the possible corresponding charge.

 

In case the order is canceled in full: - The customer's order will be canceled automatically and his account will not be charged. - FLEUR will contact the customer to inform him about the cancellation of his order and will ask him to place the order again excluding the products that are not available or will complete the order with the products.

 

In case the order is partially canceled: - The buyer's order will be validated and his bank account will be charged according to the amount of the final order that will be sent to him. - The buyer will receive the available products - The buyer will be compensated with the value of the products ordered and charged and were not available, without delays and no later than 30 days after payment of the total amount.

 
3.4 Order

Each order means the acceptance of the General Terms and Conditions of Sale and the acceptance of the General Terms of Use of the Website, Personal Data / Privacy and Use of Cookies without any reservation regarding these terms and any special agreements between the parties.

 

The correction of possible errors in the order is the responsibility of the buyer.

 

Once the buyer confirms his order by clicking on the "Complete" icon (bottom right of "order"), he is considered to be aware and has fully and unreservedly understood the applicable General Terms and Conditions of Sale, prices, suggested time and delivery costs for the volume and quantities as well as the proposed products for sale and purchase by the buyer. The order of products implies an obligation to pay the cost of the order on behalf of the Consumer. The sale is completed when the buyer places the order. FLEUR will confirm the order by sending a relevant email to the buyer's email address ("order confirmation e-mail").

 

Once this step is completed and validated, the buyer can not modify his order. In case he wants to either modify his order or cancel it he should contact the  FLEUR with the Customer Service E-shop at 210-68.22.223, 24 hours a day, 7 days a week and request the modification / cancellation.

 

Upon receipt of his order he can exercise the right of return on condition, as described in Article 6 of these General Terms and Conditions of Sale.

 

In addition, FLEUR reserves the right to cancel or suspend the entire order or delivery, whatever its nature and level of execution, in case of non-payment or partial payment of any amount owed by the buyer, in case of fraud when paying or in the event of fraud or attempted fraud while using the FLEUR page.

 

A second email will be sent to the buyer as soon as the order is sent and FLEUR is entitled to collect the full cost of the order and shipping costs. FLEUR recommends that buyers keep all of their order information in writing or digitally.

Article 4 - Payment

 

4.1 Payment Methods

The buyer assures that FLEUR has the necessary authorizations regarding the use of the selected payment method that he chose for his order during the registration of the order.

 
4.1.1 Bank cards

Accepted credit cards for FLEUR are: Visa, MasterCard and Paypal. These cards must have been issued by a European Union-based banking institution.

 
Cash on delivery

The buyer pays the exact amount of the order and its shipping costs to the representative of the Courier Service, upon delivery of the order to him. Prerequisite for the delivery of the order is the previous payment of this cost and any shipping costs.

 
4.2 Payment Terms

Payment must be made at the time of order by the buyer.

 

The buyer can pay for his order using the above payment methods, contacting if necessary with FLEUR with Customer Service E-shop at 210-68.22.223 (Monday - Sunday, 24 hours)

 

All orders, including taxes and mandatory contributions, are payable in Euro. The order of products implies an obligation of payment by the Consumer. Any bank charges that may arise are payable by the buyer.

 

Any overdue unpaid amount will bear interest at the legal rate of arrears, solely at the discretion of FLEUR and will apply immediately ten days after the invoice date or immediately after notification of rejection of the bank payment.

 

In addition, FLEUR reserves the right to cancel or suspend the entire order or delivery, whatever its nature and level of execution, in case of non-payment or partial payment of any amount owed by the buyer, in case of fraud when paying or in the event of fraud or attempted fraud while using the FLEUR page.

 
4.3 Transaction security

To combat online fraud, buyer's order information may be disclosed to any third party authorized by law or designated by FLEUR to verify buyer's identity, order validity, payment method validity used and the selected delivery method.

 

FLEUR uses appropriate methods with valid encryption techniques to ensure the security of its transactions through partner banks. The security of transactions is based on the identification of the buyer and the confidentiality of all data.  

 
 
Article 5 - Delivery and Receipt

 

5.1 General Terms

According to these BEPGs, the products ordered by the buyer will be delivered to the address indicated by the buyer and which is referred to as the delivery address ("Delivery Address").

 

FLEUR delivers to all areas of Greek territory (with the exception of areas where there is no access through courier services). Shipments are made daily except Saturdays, Sundays and holidays. Sales invoices / delivery notes are sent to the consumer along with the products ordered at the address entered by the buyer at the time of placing the order.

 
5.2 Features of the delivery methods from the Website www.fleur.gr.

 

5.2.1 The boxes are delivered to the delivery address of the buyer or the recipient of the order and if he is absent, depending on the discretion of the postal service and if this is allowed to another person, his proxy or an identifiable third party.

In case he has chosen the method of payment by cash on delivery, he must pay the total price of the order in advance upon delivery.

 

If the boxes cannot be delivered, the buyer or the recipient receives a notification at the stated address, which allows him to pick up the ordered products from the nearest postal service store at the time indicated there (10 days).

 

At the end of this period (10 days), the boxes are returned to the sender. In this case the buyer will be reimbursed with the amount he paid at the time of placing the order less shipping costs (if the payment has been made by credit card).

 

Any delivery transaction is not applicable if the box appears to have been delivered and the relevant delivery note has been signed.

 
 
5.3 Episodes, damage, damaged packaging

 

5.3.1 General Provisions

The buyer or recipient of the order is invited to confirm the good condition of the boxes and the delivered products.

 

In case of anomaly regarding the boxes (damaged or open boxes, traces of liquids, etc.) or with the ordered products (missing, damaged, etc.) the buyer or the recipient of the order should follow the following procedures mentioned in articles 5.3.2 and 5.3.3 of these General Terms and Conditions of Sale depending on the status of the order. Failure to follow the correct procedure regarding the notification of a problem may remove any liability from the carrier and FLEUR and in particular the buyer will not be entitled to compensation nor will he ever be able to claim from FLEUR the resending of the ordered products.

 
5.3.2 Procedure to be followed in case of damaged box

Delivery by Courier Service
• If an anomaly is detected in the presence of the agent of the Service

5.3.3 Procedure to be followed in case of missing or damaged products

The buyer or the recipient of the order should inform the Customer Service department of E-shop FLEUR at 210-68.22.223, 24 hours a day, 7 days a week, about the absence or destruction of the products. FLEUR can request information on the identity of the buyer or the recipient of the order and perform the necessary check, before completing the missing products or replacing the damaged ones.

 
5.4 Delivery Time

Delivery time starts from the moment the order registration confirmation is sent to the buyer. The buyer who wishes can be informed about the estimated delivery time, depending on the geographical point of delivery, by calling 210-68.22.223  (Monday - Sunday 24 hours a day). Due to increased volume and security measures, your order may be delayed.

 

IT IS CLARIFIED THAT ANY ORDER SUBMITTED AFTER 13.30 PM WILL BE REGISTERED AND EXECUTED THE NEXT WORKING DAY.

 

In case the delivery is delayed for more than 10 days from the above limits, the buyer has the right to cancel the order within 60 days from the maximum delivery time stated for the delivery of the products, sending a registered shipment with the receipt to the address of FLEUR after contacting us, during the opening hours of the Customer Service Department. The buyer can be informed about the delivery time of the order, by contacting FLEUR at 210-68.22.223, 24 hours a day, 7 days a week or by sending an e-mail to info@fleur.gr

 
Article 6 - Rights and time limit for returns

 

6.1. Right of return

 

6.1.1. Time limit for exercising the right of return.

The buyer has 30 (thirty) days from the date of receipt of the package that includes the ordered products to exercise his right to reverse the sale and return the products, without justifying his / her decision. In case the 30th day falls on a Saturday, Sunday or public holiday, then the deadline is extended until the next working day.

 
6.1.2. Details of the exercise of the right of return

Details of the right of cancellation are set out in section 6.3 of these General Terms and Conditions.

 
6.1.3. Results of the exercise of the right of return

The buyer exercises the right of return in accordance with the terms and conditions described in this article, regarding the information time and return details and can choose:

- compensation equal to the cost of the returned products, which will be paid after the payment of the order of the products, if the return takes place within the period of 30 days.

6.1.4. Return costs

6.2. Contractual Right and Return Period

FLEUR , always aiming at the satisfaction of its customers and the recipients of orders, accepts the return of the products ordered by www.fleur.gr by simple postal delivery or by direct delivery to one of its stores within the legal deadlines referred to in these terms (hereinafter referred to as "refund right").

 
6.2.1. Deadline for exercising the right of return

The return deadline can be exercised by the buyer or the recipient of the order within fourteen days (14 days) from the receipt of the order.

 
6.2.2. Details of exercising the right of return

The details of exercising the right of return are referred to in Article 6.3 of these General Terms and Conditions of Sale.

 
6.2.3. Result of the use of the right of return

The buyer or recipient of the order, who wishes to exercise the right of return, can do so as follows:

 

- change it, returning the product to a store and exchanging it for another product sold by FLEUR , of equal or greater value.

 

- Receive the value of the products returned with the same payment method followed when purchasing the products (refund)

- Receive the value of the products returned with the same payment method followed when purchasing the products (refund)

 
6.3. Details of exercising the right of return.
6.3.1. General provisions covering all means of return

The products must be returned to FLEUR within the above period of 30 days in perfect / excellent condition that allows their resale (in their original closed or sealed packaging, with accessories, instructions, etc.) and provided that they have not been used or have not been opened.

 

Products must be returned after completing the special product return form attached to the BEPGs (Annex 1). FLEUR will refund to the buyer the purchase cost of the products with the payment method followed in his order, within 14 days from the day he will be informed of the withdrawal from the sale.

 
6.3.2. Return to store

According to the terms GOPP, the return to store is possible in all FLEUR stores in Greece with the presentation of the purchase receipt.

 
6.3.3. Return by mail or courier

The buyer or the recipient of the order who exercises his right of return within the legal deadline of 30 days, must follow the following instructions when returning the products by mail / courier:

 

- Shipping the products in excellent condition and in sealed packaging with registered letter and receipt and with the completed withdrawal form from the sale - PRODUCT RETURN FORM to:

FLEUR Nikitaras 5, Vrilissia 15235. FLEUR does not accept parcels with consignee payment (with the exception of defective products or the need for product replacement).

 

If the buyer or the recipient of the order does not keep proof that he deposited the product in carriers or in a store, then the responsibility for returning the product will be borne by him.

 

The buyer or the recipient of the order who exercises his right of return within the legal deadline of 30 days, can notify the cooperating courier company, in order to set the day and time when he will deliver the package with the returned products. The return of the products will be done if the products are in excellent condition and in a sealed package with registered letter and receipt and with the completed form of withdrawal from the sale - PRODUCT RETURN FORM at the above address.

Article 7 - Retention of title

All products sold on the website are free from any legal or factual defect. Products that are modified, repaired, installed or added by the buyer are excluded from this warranty. The warranty does not apply to worn or damaged products resulting from shipment or due to improper and improper use.

The order is subject to the BEPGs that are valid at the time of its placement.

 
Article 13 - General
13.1 Partial validity

In the event that one or more of these General Terms is in any way in whole or in part invalid under applicable law, then the affected terms or parts thereof are not valid as an integral part of the contract and the remaining terms are normally valid between the parties.

 
13.2 Resignation

These General Terms are considered by the parties to be essential, and they accept their faithful observance and waive their right to challenge any of them.

3.3 Applicable Law and Jurisdiction

The Courts of Athens are exclusively responsible for resolving any dispute currently existing regarding the existence, interpretation, execution or breach of the sales contract between FLEUR and the buyer in accordance with Greek law.

 

According to Directive 2013/11 / EC, which was incorporated in Greece with JM 70330/2015, the possibility of electronic consumer dispute resolution is now provided through the Alternative Dispute Resolution (ADR) process throughout the European Union.
